Those birds are money, bruised livers go for much less on the market, and a bird's liver bruises incredibly easily. Thus, those ducks and geese are treated well. If you buy foie gras from France or the U.S., the fowl are happy. There are other countries where the fois gras might get produced in horrorshow conditions, but you'd want to avoid the stuff because it's not the good stuff anyway.
In fact, producers in the U.S. are especially careful about their geese and are also big producers of free-range, humanely raised fowl of other varieties. There is no such thing as a factory farm in the U.S. which produces fois gras. Doesn't exist. The boycott of American foie gras actually really hurts the cause of humane farming.
